1. What These Terms Cover

The Healthcare Terms apply whenever a customer uses Savvy Health and related EHR, practice-management, billing, point-of-sale, patient-engagement, analytics, AI, laboratory, claims, eligibility, e-prescribing, telehealth, portal, and messaging services provided by Swipe Savvy, Inc. ("Swipe Savvy") to process health, medical, patient, or payment data. They are incorporated into the customer's underlying services agreement and, for Protected Health Information ("PHI"), work alongside our Business Associate Agreement, which controls as to PHI. The Healthcare Services are offered in the United States only.

2. No Medical Advice; Clinical Responsibility

Swipe Savvy provides health information technology tools only. We do not practice medicine, provide clinical or professional services, or form a provider-patient relationship. The customer and its licensed professionals are solely responsible for all diagnosis, treatment, triage, prescriptions, orders, clinical documentation, medical necessity, informed consent, patient communications, and emergency response. The Services are not an emergency-response system.

3. AI and Automation Require Human Review

Any AI, machine-learning, ambient-scribe, transcription, coding-assistance, clinical-decision-support, or analytics feature is provided for informational and workflow-support purposes only. The customer and its licensed professionals must review, edit, verify, and approve all AI or automated outputs. AI outputs may not be used as the sole basis for any clinical, billing, coding, or other regulated decision. We do not use PHI to train generalized, foundation, or third-party AI models.

4. Billing, Claims, and Labs

We do not guarantee claim acceptance, payment, reimbursement, eligibility, coding accuracy, or payer compliance. Coding, billing, and claim recommendations are informational and must be reviewed and approved by the customer before submission. Laboratory features may be provided through a third-party integration partner; no production PHI is transmitted to a lab partner until an appropriate written agreement is executed. Swipe Savvy is not a clinical laboratory and does not perform or interpret tests.

5. Security and Subprocessors

We maintain commercially reasonable administrative, physical, and technical safeguards, including safeguards applicable to ePHI under the HIPAA Security Rule. We do not represent that we hold SOC 2, HITRUST, ISO 27001, or any other specific certification unless expressly stated in a signed writing. We use subprocessors to provide the Services and require PHI-handling subprocessors to enter into agreements with appropriate flow-down obligations — see our Subprocessors page. Support may be provided by personnel outside the United States, including in the Philippines, under appropriate safeguards.

6. Sensitive Data

Customers are responsible for identifying, tagging, and restricting sensitive data — including records subject to 42 CFR Part 2, psychotherapy notes, reproductive-health, HIV/STI, genetic, biometric, and minor-confidentiality data — and for obtaining required consents before submitting such data to the Services.

7. Warranties, Liability, and Insurance

The Services are provided "as is" and "as available," and liability is limited as set out in the full agreement. Swipe Savvy maintains commercially reasonable technology errors-and-omissions, professional liability, and cyber/privacy insurance appropriate for the Services, subject to the terms, conditions, exclusions, retentions, and limits of the applicable policies, evidenced by certificates of insurance on reasonable request.

8. Governing Law

The Healthcare Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, with venue in Orange County, Florida, unless a signed order form states otherwise.
